Artikel 1 – Definities

  • Ondernemer: Hester Engineering, handelend onder de naam SurfLabel
  • Klant: iedere natuurlijke of rechtspersoon die een bestelling plaatst
  • Producten: op maat gemaakte 3D-geprinte labels
  •  

Artikel 2 – Toepasselijkheid

Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen en overeenkomsten via de webshop van SurfLabel.

Door een bestelling te plaatsen gaat de klant akkoord met deze voorwaarden.

Afwijkingen zijn alleen geldig indien schriftelijk overeengekomen.

Artikel 3 – Producten en maatwerk

Alle producten worden op maat gemaakt op basis van door de klant ingevoerde gegevens (zoals naam en telefoonnummer).

De klant is volledig verantwoordelijk voor het correct aanleveren van deze gegevens.
Fouten in invoer (zoals typefouten) vallen onder verantwoordelijkheid van de klant en geven geen recht op kosteloze vervanging.

Artikel 4 – Bestelling en betaling

  • Alle bestellingen verlopen via de webshop
  • Betaling vindt vooraf plaats via het aangeboden betaalsysteem
  • Dit geldt voor zowel B2C als B2B klanten

De ondernemer behoudt zich het recht voor om bestellingen te weigeren of te annuleren, bijvoorbeeld bij:

  • vermoeden van misbruik of fraude
  • onjuiste prijsvermelding
  • onjuiste of onvolledige klantgegevens

Artikel 5 – Prijzen en fouten

Alle prijzen zijn onder voorbehoud van kennelijke fouten.

De ondernemer behoudt zich het recht voor om:

  • prijzen te wijzigen
  • fouten in productinformatie, prijzen of levertijden te corrigeren
  • bestellingen te annuleren indien sprake is van een duidelijke fout

Artikel 6 – Levering en risico

  • Producten worden geproduceerd binnen 2–3 werkdagen
  • Verzending vindt plaats via briefpost of met track & trace (keuze van klant)
  • Levertijden zijn indicatief en afhankelijk van vervoerders

Risico-overgang:

  • Bij verzending met track & trace ligt het risico bij de ondernemer tot het moment van levering
  • Bij verzending via briefpost zonder tracking ligt het risico volledig bij de klant

Adresgegevens:

De klant is verantwoordelijk voor het correct invoeren van het afleveradres.
Fouten in adresgegevens zijn voor risico van de klant.

Niet-afgeleverde of geretourneerde zendingen:

Indien een zending retour komt of niet kan worden afgeleverd, zijn de kosten voor opnieuw verzenden voor rekening van de klant.

Artikel 7 – Douane en importkosten

Bij internationale verzendingen kunnen invoerrechten, btw en/of andere douanekosten van toepassing zijn.

Deze kosten zijn volledig voor rekening van de klant.

De ondernemer zal de benodigde documentatie voor verzending verzorgen, maar is niet verantwoordelijk voor vertragingen of kosten opgelegd door douaneautoriteiten.

Artikel 8 – Herroepingsrecht

Omdat het maatwerkproducten betreft, is het herroepingsrecht uitgesloten conform Europese wetgeving.

Retourneren is uitsluitend mogelijk in de gevallen genoemd in artikel 9.

Artikel 9 – Garantie en klachten

De ondernemer hanteert een soepele garantie:

De klant heeft recht op vervanging of herstel indien:

  • het product beschadigd is bij ontvangst
  • er sprake is van een productiefout
  • het product binnen 1 jaar defect raakt bij normaal gebruik

Garantie geldt niet bij:

  • verkeerd of onjuist gebruik
  • extreme omstandigheden
  • normale slijtage

Klachten kunnen worden gemeld via: info@surflabel.com

Binnen 1 week ontvangt de klant een voorstel voor oplossing.

Artikel 10 – Aansprakelijkheid

  • Aansprakelijkheid is beperkt tot maximaal het aankoopbedrag van het betreffende product
  • Ondernemer is niet aansprakelijk voor indirecte schade of gevolgschade
  • Gebruik van de producten is volledig op eigen risico van de klant

 

 

Artikel 11 – Intellectueel eigendom

Alle ontwerpen, modellen, productvormen en afbeeldingen zijn eigendom van de ondernemer.

Het is niet toegestaan om:

  • ontwerpen te kopiëren of reproduceren
  • ontwerpen commercieel te gebruiken
  • het merk SurfLabel te gebruiken zonder toestemming

 

Artikel 12 – Gebruik van website en content

Het is niet toegestaan om:

  • de webshop te misbruiken
  • onjuiste of misleidende informatie te verstrekken
  • systemen te proberen te hacken of verstoren
  • content van de website te kopiëren zonder toestemming

Bij overtreding kan toegang tot de website worden geweigerd.

Artikel 13 – Privacy

Persoonsgegevens worden verwerkt in overeenstemming met de privacyverklaring van de ondernemer.
Deze is beschikbaar via de website.

Artikel 14 – Overmacht

De ondernemer is niet aansprakelijk voor vertragingen of tekortkomingen als gevolg van overmacht, waaronder problemen bij vervoerders, storingen of externe invloeden buiten de controle van de ondernemer.

Artikel 15 – Wijzigingen voorwaarden

De ondernemer behoudt zich het recht voor om deze algemene voorwaarden te wijzigen.

De meest actuele versie is altijd beschikbaar op de website.

Door gebruik te blijven maken van de webshop gaat de klant akkoord met de gewijzigde voorwaarden.

Artikel 16 – Scheidbaarheid (severability)

Indien een bepaling in deze voorwaarden ongeldig of niet afdwingbaar blijkt, blijven de overige bepalingen volledig van kracht.

Artikel 17 – Toepasselijk recht

Op alle overeenkomsten is Nederlands recht van toepassing.

Geschillen worden voorgelegd aan de bevoegde rechter in Nederland.

Artikel 18 – Taal

Deze algemene voorwaarden zijn opgesteld in het Nederlands.

De Engelse versie wordt uitsluitend ter informatie verstrekt.
In geval van verschillen of interpretatieverschillen is de Nederlandse versie bindend.

Article 1 – Definitions

  • Entrepreneur: Hester Engineering, operating under the name Surflabel
  • Customer: any natural or legal person placing an order
  • Products: custom-made 3D printed labels

Article 2 – Applicability

These Terms and Conditions apply to all offers, orders, and agreements made via the Surflabel webshop.

By placing an order, the customer agrees to these Terms.

Any deviations are only valid if agreed in writing.

Article 3 – Products and customization

All products are custom-made based on information provided by the customer (such as name and phone number).

The customer is fully responsible for providing correct information.
Errors in submitted data (such as typos) do not entitle the customer to free replacement.

Article 4 – Orders and payment

  • All orders must be placed through the webshop
  • Payment must be made in advance
  • Applies to both B2C and B2B customers

The entrepreneur reserves the right to refuse or cancel orders in cases such as:

  • suspected fraud or misuse
  • incorrect pricing
  • incomplete or incorrect customer details

Article 5 – Prices and errors

All prices are subject to obvious errors.

The entrepreneur reserves the right to:

  • change prices
  • correct errors in product information or delivery times
  • cancel orders in case of clear mistakes

Article 6 – Delivery and risk

  • Production time: 2–3 business days
  • Shipping via untracked mail or track & trace (customer choice)
  • Delivery times are indicative

Risk:

  • With track & trace, risk remains with the entrepreneur until delivery
  • With untracked mail, risk is fully with the customer

Address:

The customer is responsible for providing correct address details.
Errors are at the customer’s risk.

Returned shipments:

If a shipment is returned or cannot be delivered, reshipping costs are the responsibility of the customer.

Article 7 – Customs and import duties

For international shipments, customs duties, VAT, or import fees may apply.

These costs are entirely the responsibility of the customer.

The entrepreneur will provide required documentation but is not responsible for delays or charges imposed by customs authorities.

Article 8 – Right of withdrawal

As all products are custom-made, the right of withdrawal does not apply under EU law.

Returns are only accepted as described in Article 9.

Article 9 – Warranty and complaints

The entrepreneur offers a flexible warranty:

The customer is entitled to replacement or repair if:

  • the product arrives damaged
  • there is a manufacturing defect
  • the product breaks within 1 year under normal use

Warranty does not apply in cases of:

  • misuse
  • extreme conditions
  • normal wear and tear

A solution will be provided within 1 week.

Article 10 – Liability

  • Liability is limited to the purchase amount
  • No liability for indirect or consequential damages
  • Use of products is entirely at the customer’s own risk

Article 11 – Intellectual property

All designs and content are property of the entrepreneur.

It is not permitted to:

  • copy or reproduce designs
  • use designs commercially
  • use the Surflabel brand without permission

Article 12 – Website use

Users may not:

  • misuse the webshop
  • provide false information
  • attempt to hack or disrupt systems
  • copy content without permission

Violations may result in denied access.

Article 13 – Privacy

Personal data is processed in accordance with the privacy policy, available on the website.

Article 14 – Force majeure

The entrepreneur is not liable for delays or failures caused by force majeure or external factors.

Article 15 – Changes to terms

The entrepreneur may update these Terms at any time.

The latest version is always available on the website.

Continued use implies acceptance.

Article 16 – Severability

If any provision is invalid, the remaining provisions remain in force.

Article 17 – Governing law

These Terms are governed by Dutch law.

Disputes shall be submitted to the competent court in the Netherlands.

Article 18 – Language

These Terms are originally drafted in Dutch.

The English version is provided for convenience only.
In case of discrepancies, the Dutch version shall prevail.
